Terms and Conditions of Sale

Purchase Price. Buyer agrees to pay the total purchase price, including shipping and handling, if any, as specified on the invoice. Besides, Buyer agrees to pay any sales or other taxes levied on or measured by such purchase price, or arising from the use of the product(s) and any parts or maintenance supplied, including without any limitation, any additional sales, use, gross receipts, privilege, excise, and personal property taxes unless specified in writing on the invoice.

Pricing and Information Disclaimer All pricing subject to change. For all prices, products and offers, BVC Systems, Inc. reserves the right to make adjustments due to changing market conditions, product discontinuation, manufacturer price changes, errors in advertisements and other extenuating circumstances. While BVC Systems, Inc. uses reasonable efforts to include accurate and up-to-date information on the Site, BVC Systems, Inc. makes no warranties or representations as to the Site's accuracy. BVC Systems, Inc. assumes no liability or responsibility for any errors or omissions in the content on the Site.

Title And Risk of Loss. Unless otherwise specified, all orders are FOB Fremont, California. Title and risk of loss or damage to the product(s) shall pass to Buyer upon delivery to the carrier at the shipping point. Any claims resulting from goods damaged in transit, shortages received or tampering must be filed with the carrier immediately by Buyer.

Inspection. Buyer shall inspect the product(s) at delivery and shall notify Seller of any defects or discrepancies in the product(s) as delivered within 24 hours of delivery. Absent such notification, Buyer shall be deemed to have accepted the product(s) as delivered.

Limited Warranty.Seller warrants product(s) to be in good working condition and free from defects in materials and workmanship. Seller offers one year limited warranty from the original invoice date on all products except CPU's and Memory chips, which have a 30 Day Limited warranty, excluding any physical damage. Seller's liability shall be limited to repairing or replacing, at its option, any defective product which is returned, freight prepaid to Seller, according to the Merchandise Return Procedures set forth in the following section. Buyer shall bear all responsibility for shipping charges and risk of loss or damage during transit to Seller. This limited warranty is not extended beyond the original Buyer and does not cover any losses or damages that may occur as a result of the following:

  • Improper installation or maintenance.
  • Misuse, neglect or improper environment.
  • Any unauthorized modification, repair, adjustment or installation options.
  • Parts added by anyone other than BVC Systems, Inc.
  • Excessive or inadequate electrical power, or electrical surges or irregularities.
  • The breaking of certain Seals.

    • THIS WARRANTY IS IN LIEU OF ANY OTHER WARRANTY. SELLER MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE OR OF MERCHANTABILITY. IN NO EVENT SHALL SELLER BE LIABLE FOR INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES SUCH AS, BUT NOT LIMITED TO, LOSS OF PROFITS OR BUSINESS OPPORTUNITIES, AND IN NO EVENT SHALL SELLER'S LIABILITY EXCEED THE PURCHASE PRICE OF THE PRODUCT(S).

    Return Policy. Approved must be obtained from BVC Systems, Inc. prior to return of any products. All products returned without a BVC Systems, Inc. Return Material Authorization (RMA) number will be refused. To obtain credit for return products, Buyer must obtain an RMA number within 30 days of the invoice date. Absolutely no return after 30 days. Upon receipt by BVC Systems, Inc., the return products must be in a original package and condition, including all accessories and manuals. All returned products will be charged a 15 percent restocking fee. All software sales are final and absolutely no refund under any circumstances. Special orders, memory chips and CPU's are not refundable.

    Merchandise Return Procedure:

    A). It is recommended that Buyer calls and consults with BVC Systems, Inc. technical support for advice first in order to eliminate any unnecessary returns. To obtain an Return Merchandise Authorization (RMA) number, Buyer must contact the RMA Department of BVC Systems, Inc. and provide the following information:

  • Invoice number
  • Date of purchase
  • Product description and serial number
  • Detailed reason for return

    • RMA numbers are valid for 7 days from the date of issuance. Buyer will be accessed a $25.00 service charge on product(s) returned that is/are not defective.

    B) Packing and Shipping

  • Attach a copy of the original invoice with serial number circled.
  • A detailed note describing all problems.
  • Pack items in original shipping containers.
  • Mark RMA number clearly on the outside of each container.
  • Ship returned product(s) to BVC Systems, Inc. with freight prepaid and insured.

    • Payment. Payment shall be made promptly according to the terms shown on the invoice under "Terms". Terms of payment are based on the invoice date. All amounts not paid within these terms will be subjected to a late charge of 1.5% per month. The costs of collection fees and litigation to collect delinquent accounts will be added to account balances and collect from the Buyer. Returned Checks. A $25.00 fee will be charged and collected on each check returned.

    Tax:

    1. All resellers in the state of California should have a valid resale number before products are shipped out. Otherwise sale tax will be applied.

    2. No tax will be charged for orders that ship F.O.B. from BVC Systems, Inc. to any states other than California.
